Selective freedom of speech…
During my vacation I received an e-mail complaining about an article in the NY times. The article tells a story about what, on its face, seems to be unfair treatment of the Polish authorities toward some kind of offensive broadcasting. The article also suggests that the reasons for the difference in the Authorities reaction is Anti-semitism.
I don’t know, but I have a good guesses, why the author of the e-mail choose me to complain about the NY times article. In the past I wrote about my strong support in the freedom of speech, supporting the rights of bad taste cartoonist and a holocaust denial author to express their opinion; I also mentioned the Israeli humorist Anti-semitic cartoon competition.
In the e-mail Mr. Zambrowski going some length to disprove the NY Times claim that the broadcaster that was fined for offensive comments is Jewish. If she isn’t jewish, the logic flow is, than the fine cannot traced to Anti-semitic root.
Above mentioned criticism had nothing common with Kazimiera Szczuka alleged Jewish descent. I am an old client and friend of her father Stanislaw Szczuka who is excellent Polish lawyer. I can confirm that his daughter Kazimiera Szczuka was born in catholic family and was christened as a kid by well known catholic priest.Although, family of her mother Winawer has Jewish roots but it was polonized, as well as, converted into catholicism many generations ago. So, neither Polish catholic criteria nor Jewish orthodox one let accept her as a Jewish lady. Ultimately, she could be recognized as Jewish-Arian mix according to Nazi Nurnberg law. Unfortunately, she told nothing about her family history to American journalist.
On the other hand, she can also claim she is a Polish aristocrat, because Szczuka is well known historical name of Polish landlords. As she joined leftist and feminist movement, Jewish roots are more convenient for her, that’s why she prefers to demonstrate her Jewish heritage. Her family recognizes her as a rebel and a troublemaker. Once, she even accused her father of anti-Semitism what is pure nonsense.So, why those absurdities are used by American liberal media to smear Polish nation?
Mr. Zambrowski than go on and write:
We all believe in peaceful coexistence of various ethnic and religious groups. The basic rule of such democratic and civilized world should be respecting of each other culture. We cannot accept such behavior like Kazimiera Szczuka one. In another time she announced in public that she christened her dog. Could you imagine reaction of Jewish communities if some anti-Semite made known that he/she circumcised his/her
dog.
Everybody could watch angry but justified reaction of Moslems all over the world when some irresponsible Western newspaper published cartoons
ridiculing prophet Mohammed. If Kazimiera Szczuka does not feel Polish in society that is predominantly catholic she should behave like a gest in foreign country and at least respect her host.
What a display of misunderstanding and mixing of the issue Mr. Zambrowski!
lets start from the beginning, the NY times suggest for un fairness and Anti-semitism because Anti-semitic content was not fined while satire about the ultra religious radio station was:
”I called her and apologized to her, because I didn’t know she was disabled,” Ms. Szczuka said in an interview, ”even though many disabled people phoned me to say that I shouldn’t apologize.”
Still, the Polish National Broadcasting Council, which enforces broadcasting regulations, fined the commercial television station on which Ms. Szczuka had appeared the equivalent of $125,000 for insulting a disabled person and mocking her religion. It was, the Polish press has reported, the highest fine the council has levied.
That was in March. In April a regular commentator on Radio Maryja, Stanislaw Michalkiewicz, made what are almost universally deemed here to have been classically anti-Semitic statements, accusing Jews of using what he called ”the Holocaust industry” of trying to exact financial ”tribute” from Poland through property restitution claims.
But the broadcasting council has taken no action so far in the case of Mr. Michalkiewicz and Radio Maryja (pronounced Maria), even though the far-right Catholic radio station has often been a forum for comments that Jews and others here have called derogatory and insulting.
To suggest that people who offend you will be silenced or leave the country isn’t a support of freedom of speech by any criteria. I am unfamiliar with the Polish law or broadcasting level but in general terms I can suggest that both broadcasters discussed in the article demonstrate poor choices; I believe however in the rights of both of them to express their opinion. The listener have the fundamental right to not listen!
Claiming for Anti-semitism in Poland isn’t surprising and has deep historical roots, Including mascare of Jews returning from the concentration camps at the end of WWII. Arguing that Kazimiera should act as a guest, despite the fact that she has long roots in Poland, because she express opinions that offend Catholic believers, demonstrates that these roots still exist.
